The Control of Asbestos at Work Regulations 2002 came into force on 21 st November 2002 to tighten existing legislation with the aim of reducing asbestos related deaths caused by asbestos in non-domestic buildings. However one of the major changes, the duty to manage asbestos materials, did not come into force until 21 st May 2004. This requires those who have responsibilities in non-domestic premises to assess whether there is any asbestos in their premises and places a legal responsibility on duty holders to identify, manage and monitor asbestos containing materials (ACM’s) in their premises and, amongst other things, this will involve carryingouta survey of the premises by a competent person.
