Think BHS Before Dismissing!
Itís not some trendy new HR anacronym but good old British Home Stores. Whilst the business may be gone it should not be forgotten by employers as it helped to shape the employment law landscape we are familiar with today.
Forty years ago this month BHS found itself in the Employment Appeal Tribunal (EAT) defending its decision to dismiss a shopworker.
The EATís decision laid down one of the most important tests for assessing whether a dismissal for conduct is fair, a test which is still relevant today.
